1. By acknowledging this EULA, you agree to inform anyone whom you may record that their Internet and PC usage may be monitored or recorded.

2. You acknowledge that you will install this software ONLY on a PC that is yours or a PC on which you have explicit permission, granted by an owner or other permitted individual, to monitor. You specifically agree that you will NOT install PC Pandora on any PC on which you are not explicitly authorized to do so.

3. You agree to conform to all state and local laws which may impact the observation or recording of a third party's PC or Internet usage. If state or local laws prohibit the use of Internet or PC monitoring software, you agree not to install PC Pandora on any PC's governed by or located in that municipality

This is a software license agreement between Pandora, Inc. ("referred to hereafter as "Pandora" and you (referred to hereafter as "user"), as purchaser, for the use of the PC Pandora software. By using this program, you agree to accept all terms of this agreement. If you do not agree to all the terms and conditions of this agreement, do not install and use the PC Pandora program.

1. LICENSE

The Pandora software and/or programs documentation and any fonts accompanying this License whether on disk, in read only memory, on any other media or in any other form are licensed to you by Pandora, Inc. You own the media on which the program(s) is recorded but Pandora retains title to the program.

2. PERMITTED USES AND RESTRICTIONS

This License allows you to install and use the Pandora Program(s) on a single private computer or a computer you are explicitly authorized to monitor only. The program is copyrighted. You may not give, sell, rent or otherwise distribute copies of the program or its content to third parties, except as provided under the U.S. Copyright Act.

3. PERSONAL USE ONLY RESTRICTIONS

The Pandora software is made available for your personal, non-commercial use only, and may only be used on a PC which is owned by you, or owned by someone who has given you explicit permission to install Pandora software on a PC owned by that person. Use of the Pandora software for any purpose other than personal use is expressly forbidden.

4. DISCLAIMER OF WARRANTIES

THE PANDORA SOFTWARE IS SOLD "AS IS," WITHOUT ANY IMPLIED OR EXPRESS WARRANTY AS TO THEIR PERFORMANCE OR TO THE RESULTS THAT MAY BE OBTAINED BY USING THE PROGRAM. AS TO THE ORIGINAL PURCHASER ONLY, PANDORA, INC. WARRANTS THAT THE DOWNLOAD FILE OR THE DISC ON WHICH THE PROGRAM IS RECORDED SHALL BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP IN NORMAL USE AND SERVICE. IF A DEFECT IN THE DOWNLOAD FILE OR DISC OCCURS, YOU MAY CONTACT PANDORA, INC. FOR REPLACEMENT INFORMATION. IN THE EVENT OF A DEFECT, YOUR EXCLUSIVE REMEDY IS EXPRESSLY LIMITED TO REPLACEMENT OF THE DOWNLOAD FILE OR DISC.

BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR NEGLIGENCE, DEFAMATION, COPYRIGHT OR ANY OTHER CLAIMS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE PANDORA SOFTWARE, WITH THE DELAY OR INABILITY TO USE THE PANDORA SOFTWARE, OR FOR ANY INFORMATION GATHERED THROUGH THE USE OF THE PANDORA SOFTWARE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF USER HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

BECAUSE CERTAIN STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
